This document outlines the considerations related to a child’s enrollment in a SPARKGROUNDS in-person workshop and provides details of the liability and medical releases associated with all workshops.  Please read this document carefully as it does impact your rights. Take the document into account when deciding whether or not to enroll.  By executing this document, you agree that you understand and will be limited by this document.  Should you disagree with the document your child will be unable to enroll in the workshop and you will be refunded any money paid. 

In this document, “you” and “your” refers to you, the parent or guardian of a child enrolling in one of our workshops.  “We,” “us,” and “our” refers the employees and owners of SPARKGROUNDS LLC, the company that owns the SPARKGROUNDS name and brand.  "Workshop" or "workshops" refers to any in-person event held at or by us, including limited-run or single-day workshops, recurring clubs, and recurring, multiple-day classes or courses.

CONSIDERATIONS

Workshops require respect between the children, the instructor, and for the materials being used.  Children who regularly disrupt workshops, show disrespect for others, or intentionally damage or destroy materials will be administratively withdrawn.  In this case, a prorated refund will be provided. 

Children will be doing amazing projects, and their work deserves to be seen by their parents and guardians.  While children will bring home some of the projects, other projects will be completed in larger groups.  In those cases, pictures of the final projects, which could include pictures of the children, may be sent to the parents and guardians who also have children participating in the workshop.  In no cases will those pictures be sent to others outside of the workshop or used for marketing purposes.

Many of the workshops build on previously learned knowledge and often require working together in a group.  SparkGrounds will make every effort to catch a child up from an unexpected absence; however, refunds and makeup sessions cannot be provided for such unexpected absences.  Should a child miss so many sessions that the absence becomes a detriment to the workshop, then that child will be administratively withdrawn.  In this case, a prorated refund will be provided.  In the event that we must cancel a scheduled workshop session, we work to reschedule the missed workshop or we will credit the prorated value of the missed session to a future workshop.

Our primary concern is for the safety and security of the children.  Towards that end, SPARKGROUNDS makes and stores audio and video recordings of every workshop.  Those recordings are housed in a secure location, are automatically deleted within six months of the date of the recording, and are never sent to others or used for marketing purposes.  In addition, children will only be released to the parent or guardian or to individuals designated by the parent or guardian. 

In order to succeed in the workshop, and to ensure that all children have the full attention of the instructor, children must be present for the entire workshop period.  You are responsible for ensuring that your child arrives on time and is picked up within five minutes of the workshop's ending time.  Should you be unable to pick up your child as expected, immediately email support@sparkgrounds.com and call (407) 704-7858.

LIABILITY RELEASE

You understand and acknowledge that we take all possible precautions to reduce risk and provide a safe and enjoyable environment for every person; however, you acknowledge that there are inherent risks of injury that you voluntarily accept if your child participates in our workshops.  In consideration of your child’s involvement with our workshops, you hereby agree to the terms of this Liability Release.

You hereby waive and release, indemnify, hold harmless, and forever discharge SPARKGROUNDS LLC and its owners, agents, employees (paid or volunteer), officers, directors, affiliates, successors, family members, and assigns (collectively, “the Released Parties”), from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages, and liabilities, of any and every kind and nature, whether known or unknown, in law or equity, that you ever had or may have, arising from or in any way related to your child’s participation in any of the workshops offered by, conducted by, on the premises of, or for the benefit of, the Released Parties—provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, willful or wanton misconduct.

You fully understand and accept that your waiver and release, indemnification, and discharge of the Released Parties as reflected herein extends fully to any workshops that take place at a location other than our facilities themselves. This includes mobile workshops or workshops at leased locations. Lastly, you hereby release from liability all persons affiliated with SPARKGROUNDS LLC who in any fashion have helped in organizing, planning, and/or implementing workshops for us.

MEDICAL RELEASE

You understand that in the case of an emergency involving your child, every effort will be made to immediately contact you; however, in the event that you cannot be reached to make arrangements for emergency medical attention at the time of illness or accident, you hereby authorize us to call 911 to provide urgent care for your child, and further authorize your child to receive medical treatment from emergency medical providers as such medical provider deems necessary and appropriate.

You certify that you, and your children, have adequate insurance to cover any injury or damage suffered or caused while participating or you will personally pay all medical, hospital, or other expenses related to injury or damage to which your minor children may cause or incur while participating.

You also understand that you have the option to include medical considerations, such as allergies, on this document.  We agree to make our best effort in understanding and adjusting for those considerations; however, you acknowledge that, should your child have a medical consideration that makes participation in our workshop potentially dangerous, you should not enroll your child in the workshop.  We simply do not have the experience or training to provide guaranteed responses to medical considerations.

FINAL ACKNOWLEDGEMENTS & SIGNATURE

By executing this document, you signify that you have read, understand, and fully agree to each of the terms of this document. To the best of your knowledge, all of the information provided within this document is truthful, accurate, and up to date, and unless otherwise noted, your child has no physical, emotional, or social conditions that make it dangerous for your child (or a danger to others) to participate in any of our workshops.  You warrant that your child is able to follow directions, respect materials, and participate safely in all activities associated with the workshop.  And, you certify that you have custody or are the legal guardian of the child covered by this agreement.  

You also acknowledge that the provisions of this document will continue in full force and effect even after the termination of the workshop, and that this document is governed by the laws of the State of Florida.

If any of the information you have provided about your child were to change, you understand that it is your responsibility to provide us with those changes. You understand and agree that, unless otherwise expressly stated herein, no oral or written representations can or will alter the terms of this document.

By applying your Electronic Signature to this agreement, you agree that your electronic signature is the legally binding equivalent of your handwritten signature on paper. You will not, at any future time, claim that your electronic signature is not legally binding or enforceable.
